What is mediation?

Mediation is a process where impartial facilitators, working in teams of two, bring disputing parties face to face. The parties talk respectfully, sharing their sides of the story and are led through a process of coming to conclusions that are mutually satisfying to both. An agreement is signed and both parties receive copies.

How long does the process take?

Persons involved in mediation need to plan on  2 hours for the entire process. Sometimes a second session is needed if further information is required before an agreement can be reached.

Where do mediations take place?

Mediations are held at the CMC office or in a location more convenient to all parties. They are held in neutral places where neither party has a personal connection.

Can I bring witnesses?

The mediation process involves a discussion directly between the parties involved. The two mediators and persons in conflict sit in a circle facing each other. It is not necessary to have witnesses present since a disputant isn’t “building a case” against the other person.

How effective is mediation?

What makes mediation effective is that the parties meet face to face and listen to each other to understand the impact the dispute has made on their lives. When all persons have the goal of “making it right” between them, the process proves to be most effective.

What is the outcome of mediation?

Often parties agree or disagree but a majority of the cases involve specific details as to how all parties can be mutually satisfied. If physical harm has been done or property damaged, part of the agreement may be restitution in the form of community service or monetary payback. There are times when an apology is all that is needed.

Is mediation like counseling?

Mediation is beneficial to the parties who take part in it, but it is not counseling.  A counselor adds his or her perspective and advice, whereby a mediator stays neutral and allows those present to create their own solutions. 

Why should I choose mediation over going to court?

Mediation is set up to address the harm that is felt by all parties and come to an agreement that is specific to that situation.  It allows the parties to be heard and to address causes, so that it can be made right for the parties involved, which in turn helps the community as a whole to heal.

When would mediation take place?

Mediation is set up at the convenience of the parties involved.  If you work during the day, mediation takes place in the evening.  If you work during the evening, mediation takes place during the day. 

How much does mediation cost?

CMC uses a sliding scale to determine the cost/fee.  CMC will work with you to find a way to be able to afford mediation.  It is much less time consuming and much more cost efficient than using other options.
